Si el hecho declarado por el Consejo fuere de un género distinto del delito porque se ha procedido, se declarará terminada la causa respecto del hecho o hechos a que se hubiere contraído ésta, y pasará la actuación al Comando Superior para que se provea lo conveniente respecto a la infracción declarada por el Consejo.
