En cualquier estado de la investigación, cuando aparezca plenamente demostrado que el hecho imputado no ha existido, o que el investigado no lo cometió o que la ley no lo considera como infracción disciplinaria, o que la acción disciplinaria no podía iniciarse o proseguirse, se ordenará mediante providencia motivada proferida por el Jefe de la dependencia investigadora e! archivo definitivo del expediente
