Factor Territorial

Es competente el funcionario de la Policía Nacional con atribuciones disciplinarias del territorio donde se realizó la conducta, y en los casos de omisión, donde debió realizarse la acción.

Cuando la falta sea continuada y cometida en diversos lugares del territorio nacional, conocerá el funcionario competente donde se haya cometido el último acto.

Parágrafo

En situaciones administrativas se aplicará el factor territorial, sin perjuicio a la competencia funcional dispuesta para los oficiales superiores.
