Si hubiere de juzgarse a la vez a un individuo por hechos punibles con penas privativas de la libertad, de un mismo género, se le condenará al maximum de la más grave de ellas, con un aumento igual a la mitad de las penas sumadas que le corresponderían por los demás delitos cometidos, pero sin que la pena total exceda en ningún caso del maximum que la ley señala para cada especie de pena.
