Prohibición de conceder beneficios por colaboración al instigador o promotor. Los beneficios por colaboración no se podrán conceder al Instigador o Promotor de la conducta anticompetitiva denunciada. Para acceder a los beneficios, el Solicitante declarará que, para efectos de la conducta que delata, no ha sido instigador o promotor. El que afirme que otro es Instigador o Promotor de la conducta anticompetitiva, deberá probarlo. En todo caso, durante el programa de beneficios por colaboración se aplicarán los postulados del principio constitucional de buena fe.
