El inciso segundo del artículo 67 del Decreto 2700 de 1991, quedará, así:

"Artículo 67. Quiénes ejercen funciones de instrucción . La Fiscalía General de la Nación actuará a través del Fiscal General de la Nación, los fiscales que éste delegue para casos especiales y los fiscales delegados ante la Corte Suprema de Justicia, los Tribunales Superiores de Distrito, los jueces penales de circuito especializados, penales de circuito, promiscuos de circuito, penales municipales, los jueces promiscuos municipales y los jueces de menores."
