Art 120. Si el Juez se concediere uno de los recursos de que trata el artículo anterior sin que el recurrente haya pagado las costas, el Superior se abstendrá de conocer, a petición de la parte contraria, y ordenara que se devuelva la caución al juzgado de su procedencia, sin perjuicio de disponer lo conveniente para hacer efectiva la responsabilidad en que incurrido el Juez.
