La persona a quien se exija el juramento decisorio por pedirlo parte legítima u ordenarlo la ley, está en el deber de prestarlo en la fecha y a la hora que el Juez señale en el respectivo auto, el que se notifica personalmente. Si la persona no es hallada, se le manda citar y se procede como para la absolución de posiciones.
