Cuando el inculpado sea un Oficial o un Civil con categoría de Oficial la convocatoria del Tribunal y la designación de sus integrantes corresponderá al Comandante de Unidad Operativa del Ejército, Armada o Fuerza Aérea, a la cual pertenezca, en el momento de comisión de la falta. Cuando a la investigación estuviere vinculado personal perteneciente a diferentes Unidades, Reparticiones o Fuerzas, corresponderá decidir al superior de todos ellos.
