° El expediente que ha de instruirse en cada caso para los efectos del artículo 4.° del Decreto legislativo número 5 de 1906, será el que determina el artículo 1.° de la Ley 19 de 1894, cuando se trate de adicionar partidas insuficientes de gastos previtos en el Presupuesto respectivo. Cuando el gasto no esté previsto en el Presupuesto y sea en consecuencia extraordinario, el expediente que se instruya será el prescrito por el artículo 4.° de la Ley citada.
