NATURALEZA JURIDICA. La prestación de servicios de salud en forma directa por la Nación o por las entidades territoriales, se hará principalmente a través de las Empresas Sociales del Estado, que constituyen una categoría especial de entidad pública descentralizada, con personería jurídica, patrimonio propio y autonomía administrativa, creadas por la ley o por las asambleas o concejos, según el caso, sometidas al régimen jurídico previsto en este capítulo.
