El empleado a quien se conceda una licencia no puede separarse de su puesto mientras no se posesione el que deba reemplazarlo; y el que reemplace al que está con licencia debe funcionar hasta que se encargue del Despacho el Principal, o quien deba reemplazarlo.

Exceptúanse el caso en que no sea preciso llenar la falta, o cuando se conceda una licencia con justa causa, pues entonces el agraciado puede hacer uso de ella inmediatamente, aunque no se le reemplace.
