º. El Juez competente debe dictar, dentro de tres (3) días, la correspondiente sentencia decretando la expropiación, para lo cual tendrá únicamente en cuenta los elementos a que se refiere el artículo 852 del Código Judicial. El fallo se notifica en la forma que prescribe el artículo 17 de la Ley 35 de 1915 .

Si el Juez denegare la expropiación por considerar insuficientes los elementos en cuestión, el actor puede apelar de la providencia en el efecto suspensivo.
