ARTICULO 4 º. GARANTIAS EN ACTIVIDADES MINERAS. En desarrollo del artículo 60 de la Ley 99 de 1993, toda persona que desarrolle un proyecto de minería a cielo abierto constituirá a favor de la autoridad ambiental competente una póliza de garantía de cumplimiento equivalente, como máximo al 30% del costo anual de las obras de recuperación o sustitución morfológica, que se pretendan desarrollar conforme al plan de manejo ambiental. La póliza deberá ser renovada anualmente y tener vigencia durante la vida útil del proyecto y hasta por dos años más a juicio de la autoridad ambiental.
