Presentada la demanda, el Juez ordenará el secuestro de los bienes y nombrará el secuestre.

Si al tiempo del secuestro los bienes se hallaren en poder de alguna persona que alegue algún derecho, se le dejarán en su poder y se le apercibirá para que se presente a estar a derecho en el juicio. Lo mismo si estuvieren en depósito.
