El Director General de la Policía Nacional, definirá la estructura de la Policía de Infancia y Adolescencia, que en todo caso deberá tener un encargado que dependerá directamente de la Dirección de Protección y Servicios Especiales que a su vez dependerá del Subdirector General y con presencia efectiva en los comandos de Departamento, Metropolitanas, Estaciones y Organismos Especializados.
