Las autoridades que conozcan de los procesos de que trata la primera parte del artículo anterior dictarán inmediatamente el auto de prescripción respectivo, y pondrán en libertad al procesado ó procesados si estuvieren detenidos. De todo lo cual se dejará la debida constancia en el expediente.
