Tan pronto como llegue a conocimiento de un funcionario de instrucción que se ha realizado un hecho que constituye delito, cuyo conocimiento corresponde a la Jurisdicción Penal Militar, y si es competente, procederá a iniciar la investigación penal correspondiente y a dictar auto cabeza de proceso después de nombrar y posesionar a un secretario. Si no es competente, procederá a dar aviso al funcionario que lo sea.
