Cuando sea un magistrado del Tribunal Superior Militar, el impedido o recusado deberá manifestarlo a la Sala Penal de la Corte Suprema de Justicia para que sea sustraído del conocimiento del asunto.

De los impedimentos y recusaciones del secretario del Tribunal Superior Militar conocerá el magistrado ponente. Sí se acepta, así lo declarará y será reemplazado por el oficial mayor de la corporación.
