Prueba para desvirtuar la presunción de no operatividad. La sociedad mercantil podrá desvirtuar la presunción de no operatividad en el plazo otorgado, acreditando que la sociedad se encuentra operativa, es decir, que está desarrollando su objeto social, mediante una certificación del representante legal o cualquier otra prueba que así lo demuestre. Lo previsto en el presente artículo, no exime a la sociedad comercial del cumplimiento de las obligaciones derivadas de la calidad de comerciante previstas en la ley y la entrega de la información financiera a la Superintendencia de Sociedades.
