Los depósitos judiciales de que trata el Articulo 3° de la Ley 92 de 1920 ,se harán, según las reglas que en él se determinan, en establecimientos bancarios, en sociedades comerciales y en personas naturales que por su reconocida solvencia estén en capacidad de devolver las sumas depositadas llegado el momento, este que el Juez siempre debe tener en cuenta. El Juez ordenara la devolución de dichas sumas con los respectivos intereses que el depósito haya producido.
