Son incapaces de toda herencia o legado las cofradias, gremios o establecimientos cualesquiera que no sean personas jurídicas.

Pero si la asignacion tuviere por objeto la fundacion de una nueva corporacion o establecimiento, podrá solicitarse la aprobación legal, i obtenida ésta valdrá la asignacion.
