El comerciante declarado en quiebra, que no lleve los libros o documentos de contabilidad exigidos por la ley, incurrirá en la pena de uno a dos años de prisión.

Esta pena podrá reducirse hasta en la mitad, cuando el quebrado no los haya llevado en legal forma dentro de los tres años anteriores a la declaración de quiebra.
