Se concederá el amparo de pobreza a la persona que no se halle en capacidad de atender los gastos del proceso sin menoscabo de lo necesario para su propia subsistencia y la de las personas a quienes por ley debe alimentos, salvo cuando pretenda hacer valer un derecho litigioso a título oneroso.
