Se prohíbe a terceros el empleo de un nombre comercial o de una marca de productos o de servicios, que sea igual o similar a un nombre comercial ya usado para el mismo ramo de negocios, salvo cuando se trata de un nombre que por ley le corresponda a una persona, caso en el cual deberán hacerse las modificaciones que eviten toda confusión que a primera vista pudiera presentarse.
