Para la división de las comunidades de más de cien años de existencia, en las cuales haya sucesiones hereditarias indivisas, no es menester que se liquiden esas sucesiones previamente; en consecuencia, los árbitros de que trata la Ley 30 de 1888 tienen potestad para hacer la división entre los herederos de los comuneros muertos, de acuerdo con los títulos que se presenten.
