Para la excarcelación debe presentarse, previamente, caución hipotecaria o en dinero en cuantía superior al veinte por ciento (20 %) del precio de la mercancía, y cuando éste no se hubiere fijado, en cuantía suficiente, según apreciación del Juez. Cuando el precio de la mercancía sea inferior a cincuenta mil pesos ($ 50.000.00) o se trate de contrabando culposo, la caución para la excarcelación será del cinco por ciento (5%).
