Art. 98. En el último de los casos del artículo 827 del código judicial la sentencia se ejecutoria por solo el transcurso del tiempo; pero es preciso que la parte interesada pida que se declare la ejecutoria el juez o tribunal superior respetivo quien la declara con citación de las partes contrario pudiendo esta excepción que el tiempo no se a vencido, o que ha estado en suspenso por causa legal.
