La prescripción que consagra el Artículo 12 de la Ley 200 de 1936 sobre régimen de tierras, puede alegarse como excepción o ejercitarse como acción conforme al procedimiento que señala la Ley 120 de 1928. Pero para demostrar que tal prescripción se ha realizado no bastará probar la posesión de que trata el Código Civil, sino la determinada en el Artículo 1º de la mencionada Ley 200 de 1936, o sea la que se haya traducido en una explotación económica del suelo.
