Es prohibido a los Departamentos y Municipios cobrar derechos de vado e impedir el libre paso de los ríos; pero sí podrán cobrar retribución o impuesto por el uso de barcas u otras embarcaciones que establezcan o tengan establecidas para el paso de los ríos, como también derechos de pontazgo sobre los puentes que construyan o hayan construído a su costa. No obstante, no podrán cobrar tales impuestos o derechos en los pasos que al comuniquen un Departamento con otro, sin que los impuestos o derechos sean establecidos de común acuerdo entre los respectivos Departamentos.
