A los individuos menores de diez y seis años sindicados o procesados por delitos contra la propiedad, podrá concederse la libertad provisional, cuando el Juez o Tribunal lo creyere conveniente, con las condiciones prescritas y aunque la pena aplicable fuere superior a tres años de reclusión o presidio.
