Si los ingresos pactados llegaren a ser superiores a los previstos en esta Ley, la parte de los ingresos de Ecopetrol, que no deban ser ahorrados, podrán servir, una vez cubiertos los gastos de inversión de Ecopetrol, para atender las necesidades de recursos de carácter contingente de que trata el artículo 1º de la Ley del Plan Nacional de Desarrollo y de Inversiones Públicas, quedando excluida de esta consideración los recursos de entidades distintas a Ecopetrol.
