El que en ejercicio de sus funciones militares, o con ocasión de ellas, y por medio de artificios o engaños, obtiene un provecho ilícito, en perjuicio de los intereses del Estado o de las Fuerzas Militares, incurre en prisión de seis meses a seis años y en multa hasta de quinientos pesos.
