Se castigará con prisión de cuatro a diez años al que ejecute un acto que tenga por objeto hacer tomar armas a habitantes de la República en contra de los Poderes constituidos legalmente.

Pero si la insurrección estallare, en su autor o quien lo dirija serán castigados con prisión por doce a diez y ocho años.
