Si la persona de quien se solicite una exhibición prueba que con ella sólo se propone el interesado causarle una molestia o perjuicio o descubrir un secreto, no se ordena la exhibición y se condena a quien la pidió, si es manifiesta su temeridad, al pago de las costas y de los perjuicios.
