Recibido el proceso, el funcionario de s egunda instancia deberá decidir dentro de los veinte (20) días hábiles siguientes.

El funcionario de segunda instancia podrá decretar de oficio la práctica de las pruebas que considere necesarias para decidir la apelación, por un término máximo de diez (10) días hábiles, libres de distancia, pudiendo comisionar para su práctica.

Nota: La modificación realizada por el artículo 140 del Decreto Ley 403 de 2020, fue declarada inexequible por la sentencia C-090 de 2022, por lo cual el texto vigente corresponde a la versión anterior a dicha modificación.
