Presúmese parcialidad:

1ºEn los ascendientes a favor de sus descendientes, o al contrario, salvo en causas sobre edad o parentesco;

2º En la mujer por su marido, en éste por su mujer, y en un hermano por otro mientras vivan bajo la patria potestad;

3ºEn el que tenga interés en la causa, a favor de la parte con quien estén armonizados sus intereses;

4º En el abogado, defensor o apoderado, a favor de su cliente en la causa que defiende;

5º En los guardadores a favor de sus pupilos en los asuntos relacionados con la guarda;

6º En los obligados al saneamiento a favor de aquel a quien tienen que responder del éxito del juicio;

7º En los condueños entre sí, a favor unos de otros, en asuntos relativos a la causas común; y

8º En el enemigo capital contra su enemigo.
