El que con el fin de cometer un delito, diere principio a su ejecución pero no lo consumare por circunstancias ajenas de su voluntad, incurrirá en una sanción no menor de la mitad del mínimo ni mayor de las dos terceras partes del máximo de la señalada para el delito consumado.
