Tratándose de pensionistas por invalidez y vejezy de beneficiarios de pensiones de sobrevivientes, cuyos derechos a las respectivas pensiones hayan sido adquiridos envirtud de la totalización de períodos, según lo prescrito en el Instrumento, la institución competente será la del lugar de su residencia, Si la tuviere en uno de los Países Miembros que concurrieron a la totalización y siempre que la legislación de este reconociere derecho a prestaciones de enfermedad y maternidad a dichos pensionistas y beneficiarios.
