Temeridad o mala fe. Se considera que ha existido temeridad o mala fe, en los siguientes casos

Cuando sea manifiesta la carencia de fundamento legal de la demanda, excepción, recurso, oposición, incidente o trámite especial que haya sustituido a este.

Cuando a sabiendas se aleguen hechos contrarios a la realidad.

Cuando se utilice el proceso, incidente, trámite especial que haya sustituido a éste o recurso, para fines claramente ilegales o con propósitos dolosos o fraudulentos.

Cuando se obstruya la práctica de pruebas.

Cuando por cualquier otro medio se entorpezca reiteradamente el desarrollo normal del proceso.
