Todo exceso obtenido en una adjudicación es denunciable en cualquier tiempo como baldío, por cuanto se reputa no haber salido del dominio nacional.

El denunciante que pruebe la existencia del exceso tiene derecho a que se le adjudique gratuitamente la mitad de dicho excesos y la preferencia para que se le adjudique el resto a cualquiera de los títulos establecidos en este Código, en cuanto el total no comprenda una extensión mayor de dos mil quinientas hectáreas.
