Cuando la persona citada personalmente no se presentare a absolver posiciones en la hora y lugar designados, se presumirán ciertos los hechos a los cuales debía dar contestación.

Cuando la citación se haya hecho en la forma prevista por el artículo 606, también se presumirán ciertos los hechos, si dentro de los diez días siguientes a la notificación no se presenta el citado, en horas de despacho, a absolver las posiciones.
