Cuando pueda concederse la condena condicional, pero hubiere fundado temor de que, en poder de las personas bajo cuyo cuidado esté el menor, no tiene el ambiente ni los elementos necesarios para su corrección o mejora, debe el Juez aplicarle la libertad vigilada con prescindencia de aquellas personas y por un tiempo no inferior a un año, ni mayor del que le falte al menor para cumplir veinticinco.
