Requieren querella de parte, los delitos de calumnia e injuria militares. La querella puede ser presentada verbalmente o por escrito, por el ofendido o por sus herederos o representante legal cuando se trate de incapaces. . Los querellantes podrán desistir en cualquier estado del proceso ante el funcionario que tenga en ese momento el conocimiento, con observancia de los requisitos que la ley exige para todo, desistimiento judicial.
