Todas las personas que presten sus servicios al Fondo son empleados públicos y, por lo tanto estarán sometidos al régimen legal vigente para los mismos.

No obstante lo anterior, y conforme al artículo quinto del Decreto 3135 de 1963, serán trabajadores oficiales las personas que vayan a desarrollar actividades de construcción y sostenimiento de obras públicas.
