Los herederos anotados en el artículo anterior, no tendrán derecho a pensión o cesarán en el goce de ella cuando se encuentran en alguno de los casos siguientes:

Haber contraído matrimonio si se trata de mujer

Ser varón en goce de empleo público

Estar la viuda del Oficial, al tiempo del fallecimiento de éste, divorciada por culpa de ella; y

No ser acreedor a esta gracia por notoria mala conducta.
