Estará sujeto a la pena de tres a seis años de prisión el comerciante declarado en quiebra que dentro de los dos años anteriores a tal declaración o después de ella, haya realizado uno cualquiera de los siguientes hechos:

Distraer, disimular u ocultar total o parcialmente sus propios bienes;

Simular o suponer enajenaciones, gastos, deudas o pérdidas, y

Desistir de una pretensión patrimonial cierta, renunciarla o transigir sobre ella, sin justa causa y en perjuicio de sus acreedores.
