Los Agregados Militares de Embajadas y Legaciones, no tendrán el carácter de personal de la carrera diplomática y consular, y deberán ser nombrados entre Oficiales del Ejército activo, de los grados de Capitán u Oficial Superior. El Gobierno preferirá para tales designaciones a aquellos que hayan hecho el curso de Estado Mayor de la Escuela Superior de Guerra.
