Definición de preexistencia. Se considera preexistencia toda enfermedad, malformación o afección que se pueda demostrar existía a la fecha de iniciación del contrato o vinculación, sin perjuicio de que se pueda diagnosticar durante la ejecución del contrato sobre bases científicas sólidas.

La demostración de la existencia de factores de riesgo, como hábitos especiales o condiciones físicas o genéticas, no podrá ser fundamento único para el diagnóstico a través del cual se califique una preexistencia.
