Cuando en la constitución del fideicomiso no se designe espresamente el fiduciario, o cuando falte por cualquiera causa el fiduciario designado, estando todavía pendiente la condición, gozará fiduciariamente de la propiedad el mismo constituyente, si viviere, o sus herederos.
